The Federal Government, through the Department of Health and Human Services, has mandated compliance with the privacy and security regulations laid out in the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”).  HIPAA includes requirements and aggressive timelines for compliance, as well as penalties for non-compliance.  HIPAA Security is the last of the three major sections of the Administrative Simplification section of the entire HIPAA law.  The first two laws, Privacy and Transactions, have already past their implementation dates.  The Security Rule requires that entities implement a comprehensive security program to protect electronic protected health information (EPHI) which is used and maintained within the entity.  The entity should learn and understand these rules whether they file claims electronically or not.  These rules are considered “Best Practices” in the healthcare community and will be mandated for all entities regardless of size.
